Petitioner is accused of Bahera P.S. Case No. 261 of 2013 registered under Sections 147, 148, 149, 341, 323, 324, 307, 302 and 504 of the Indian Penal Code.
Considering the allegation attributed to him and the other materials available on record, his prayer for bail was considered and rejected vide order dated 18.05.2015 (Annexure-1) observing that the petitioner shall, however, have liberty to renew prayer for bail if all prosecution witnesses are not examined within five months.
Upon expiry of the period of five months, the petitioner renewed his prayer for bail in the Trial Court which was rejected
Patna High Court Cr.Misc. No.55749 of 2015 (3) dt.17-02-2016 2/2 and hence this application.
Status report was called for from the Trial Court which is placed at Flag-A,on perusal whereof, it appears the prosecution has already completed the examination of witnesses inasmuch as the case was slated on 27.01.2016 for examination of the petitioner/accused under Section 313 Cr.P.C. The Trial Court has also noted that effort shall be made to conclude the trial within two months.
Considering the aforesaid fact, I am not persuaded to release the petitioner on bail. Prayer is, accordingly, rejected. (Kishore Kumar Mandal, J) Pankaj/- U T
