The petitioner seeks bail in connection with Pupri P.S. Case No.136 of 2016 registered under Sections 399, 402 and 414 of the Indian Penal Code besides Sections 25(1-b)a, 26 and 35 of the Arms Act, Sections 3/4 of the Explosive Substance Act and Section 47(A) of the Bihar Excise Amendment Act, 2016. The accusation is that on receiving secret information about assemblage of the miscreants near D.A.V. School Road, Pupri, for committing heinous crime, the police reached there and apprehended seven persons including the petitioner. On search, the petitioner was found in possession of one live cartridge.

Patna High Court Cr.Misc. No.3458 of 2017 (2) dt.14-02-2017 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in custody since 08.07.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Pupri at Sitamarhi, DistrictSitamarhi, in connection with Pupri P.S. Case No.136 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
