The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 379, 354, 386, 447, 504 and 506/34 of the Indian Penal Code. Prosecution case in nutshell is that petitioner along with other accused persons entered into the house of the informant and started abusing and snatched the chain worth Rs.60,000/- on the point of pistol and also threatened and demanded Rs.5,00,000/- from the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injuries, as alleged, in

Patna High Court CR. MISC. No.10093 of 2022(2) dt.24-08-2022 2/2 separate incident. He further submits that no ransom money was executed and there is no recovery of stolen article from the conscious possession of the petitioner and other accused persons.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Sadar Hajipur P.S. Case No. 882 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
