In this case, the petitioner is challenging the notification dated 16.6.2018, whereby, the petitioner has been transferred from Aurangabad to Benipur, Darbhanga.
The petitioner has already been relieved and joined at the new place of posting. Now a grievance has been raised that as per government circular, in case of one year left for retirement, the choice posting will be given to an employee concerned. It has been submitted that as the petitioner is getting his treatment at Patna, so, he may be allowed to remain in the Aurangabad district.
Patna High Court CWJC No.11989 of 2018 dt.23-07-2018 2/2 Let the petitioner should file a representation to the Principal Secretary, Department of Personal (Karmik) and General Administration Department, Patna, who will consider the case of the petitioner keeping in view the executive instruction with regard to choice of the posting with respect to an employee whose date of retirement has been left for one year and will dispose of the same within a period of four weeks from the date of filing of the representation along with a copy of this order. With the aforementioned observation and direction, this writ application is disposed of.
