ANJANA MISHRA ORAL ORDER 10-02-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

It appears that the petitioner is in custody for over 10 years in connection with Samastipur Town P.S. Case No.47 of 2003, corresponding to Sessions Trial No.294 of 2015, registered for offences punishable under Sections 363/364/34 of the Indian Penal Code and only recently on 13.05.2015 the case has been committed to the Court of Sessions bearing Sessions Trial No.294 of 2015.

In view of the fact that there has been a long delay in conducting the trial and that too only because the commitment has been made after almost 10 years of the occurrence, it is considered

Patna High Court Cr.Misc. No.3862 of 2016 (2) dt.10-02-2016 2/2 expedient to release the petitioner above named on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge, II, Samastipur, in connection with Samastipur Town P.S. Case No.47 of 2003, corresponding to Sessions Trial No.294 of 2014, subject of the conditions that:- (i) one of the bailors will be a close relative of the petitioner i.e. his father and;

(ii) the petitioner shall remain present in the Court proceeding for facilitating the trial on each date and if he fails to remain present on two consecutive dates without there being any reasonable explanation, it shall be open to the Court below to cancel the bail of the petitioner.
