JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The report of learned trial court goes to show that Sessions Trial No. 351 of 2014/ 727 of 2014 arising out of Khusrupur P.S. Case No. 26 of 2012 could not be disposed of due to delaying tactics of the defence.
However, it is informed on behalf of the informant that argument in the aforesaid case is going on. Therefore, taking note of the aforesaid submission as well as facts and circumstances of the case, I am not inclined to
Patna High Court Cr.Misc. No.8259 of 2017 (4) dt.12-04-2017 2/2 release the petitioner on bail. Hence, his prayer for bail in connection with above stated case stands rejected. However, learned trial court is directed to dispose of above stated Sessions Trial No. 351 of 2014/ 727 of 2014 within a month from the date of receipt/production of copy of this order even taking the aforesaid case for argument on day to day basis.
