The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273, 414 and 34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 158 litres of IMFL was recovered from the Bolero vehicle wherein the petitioner was also travelling.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from his possession. The petitioner is neither the driver nor the owner of the vehicle

Patna High Court CR. MISC. No.20482 of 2021(2) dt.04-09-2021 2/2 nor has he any concern with the seized article. He is in custody since 25.11.2020 and has no criminal antecedent. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner having remained in custody for over 9 months, the petitioner is directed to be enlarged on bail in connection with Kanti (Panapur O.P.) P.S. Case no. 691 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
