The petitioner is an accused in connection with Gopalpur P.S. Case No. 33 of 2015, registered under Section 302/34 of Indian Penal Code, pending in the Court of Additional District & Sessions Judge-I, Patna.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, the petitioner, who is own sister of the deceased has falsely been implicated in this case only on the ground that she was also sleeping in the same room in which the deceased was found dead. Learned counsel for the State vehemently opposed the prayer of the petitioner and submits that though the petitioner is not named in the F.I.R., but in course of investigation, the petitioner confessed her guilt about committing murder of her own sister and on
Patna High Court Cr.Misc. No.4810 of 2017 (2) dt.28-02-2017 2/2 the basis of her confessional statement, knife was recovered, which was used in the murder of her sister.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected (Rajendra Kumar Mishra, J) manish/- U T
