The petitioner seeks regular bail in connection with Paliganj P.S. Case No. 16 of 2019, registered for the offence punishable under Sections 272, 273 of the Indian Panel Code, Section 2(E)/3/5/18 of the Bihar Excise (Mahua Flower) Rules 2006 and Sections 3(a))C)(D) of the Bihar Prohibition & Excise Act, 2016.

The allegation is regarding recovery of 2430 Kg. of illicit Mahua Flower from a pickup van.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he has filed a supplementary affidavit today, which is taken on record, stating that the said pickup vehicle and the

Patna High Court Cr.Misc. No.8982 of 2019(2) dt.18-02-2019 2/2 seized motorcycle are not registered in the name of the petitioner and the petitioner has not got nothing to do with the alleged crime. The petitioner is stated to be languishing in custody since 12.01.2019.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Paliganj P.S.
