====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 18-01-2022 Heard learned counsel for the petitioners and learned APP for the State.

Learned counsel for the petitioners is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504 of the Indian Penal Code.

Patna High Court CR. MISC. No.20091 of 2021(3) dt.18-01-2022 2/3 It is submitted by learned counsel for the petitioners that petitioner No. 2 namely Pappu Pandey has been arrested. Hence, he seeks permission to withdraw the petition with regard to petitioner No. 2. Permission is accorded.

Accordingly, the petition with regard to petitioner No. 2 is dismissed as withdrawn.

So far as petitioner No. 1 is concerned, it is alleged against petitioner No. 1 that he assaulted with spade on the head of the informant, as a result of which, the informant fell on the ground and sustained head injuries. The injury report of the informant is part of the case diary which suggests the injuries to be grievous in nature.

Considering the fact that informant received grievous injuries due to assault made by petitioner No. 1, this Court is not inclined to grant anticipatory bail to the petitioner No. 1. The prayer for anticipatory bail of the petitioner No. 1 stands rejected.

No.20091 of 2021(3) dt.18-01-2022 3/3 However, if the petitioner No. 1 surrenders before learned Court below within a period of four weeks from today and pray for regular bail, the same may be considered by the learned Court below without being prejudiced by the order of this Court.

With the aforesaid observation/direction, the petition stands disposed off.
