The petitioner is in custody in connection with Manjhi P.S. Case No. 89 of 2015 for the offence registered under Sections 147, 341, 323, 324, 307, 379, 504 and lastly added Section 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that there is case and counter case between the parties on account of old enmity with regard to land dispute. It is further submitted that though the petitioner is said to have attacked the deceased with iron rod, there is no such injury found on the head of the deceased. It is further submitted that similarly situated co-accused persons, namely, Asha Kumari @ Asha Kumar and Kaushalya Devi @ Shushila Devi have been granted bail by this court vide order
Patna High Court Cr.Misc. No.58642 of 2015 (2) dt.05-02-2016 dated 13.10.2015 and 03.11.2015 passed in Cr. Misc. No. 39652 of 2015 and Cr. Misc. No. 45331 of 2015 respectively. Considering the aforesaid facts and circumstances of the case and that petitioner has no criminal antecedent, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sessions Judge, Saran at Chapra in connection with S.T. No. 1314 of 2015 (579/2015) arising out of Manjhi P.S. Case No. 89 of 2015. (Anjana Mishra, J) Jagdish/- U T
