The petitioner, who is in custody, seeks bail in connection with Goh P.S.Case No. 86 of 2011 registered under Sections 147, 148, 149, 342, 323, 379, 384 and 435 of the Indian penal Code, Section 27 of the Arms Act and Section 17 of the Criminal Law Amendment Act.

Allegation in brief is that some unknown persons set the JCB machine of the informant's Road Construction Company on fire as demand of levy was not fulfilled.

Submission is that except the disclosure of the name of the petitioner by another co-accused Mrityunjay Mishra in his confessional statement, there is no material against him and other

Patna High Court Cr.Misc. No.5121 of 2017 (3) dt.08-03-2017 2/2 co-accused persons of this case, namely, Jitendra Singh @ Tiger and Anil Chandravanshi have been granted bail by the co-ordinate Bench of this Court vide order dated 22.09.2016 and 21.12.2016 passed in Cr. Misc. No. 33254 of 2016 and Cr. Misc. No. 49528 of 2016 respectively and the case of this petitioner also stands on similar footing.

Having considered the aforesaid facts and circumstances, the petitioner, Binod Chandravanshi @ Binod Singh, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Divisinal Judicial Magistrate, Daudnagar, Aurangabad in connection with Goh P.S. Case No. 86 of 2011.
