JUSTICE SHIVAJI PANDEY ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Informant. In this case, the petitioner is seeking bail in connection with Kharagpur P.S. Case No. 143 of 2015 for offence under Sections 341, 324, 326, 307, 302/34 of the Indian Penal Code.
An allegation has been made in the First Information Report that the Informant along with his brother had gone to see the sacrifice being performed at Kali Temple. The villagers Ranbir Yadav and Niraj Yadav brought the Informant and his brother at the bank of the river where they started butchering them with axe. The Informant's brother died at the place of occurrence and the accused persons left the Informant under the impression that he
Patna High Court Cr.Misc. No.57187 of 2015 (3) dt.19-02-2016 too has died.
In the present case, learned counsel for the petitioner has submitted that except Informant, there is no one to narrate the story and the petitioner has been falsely implicated in this case. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, namely, Niraj Kumar, is rejected.
