This application is for grant of bail in connection with Jhajha P.S.Case No.250 of 2016 for the offence under Sections 25(1-b) a, 26, 35 of the Arms Act and Section 3 and 4 of the Explosive Substance Act and Sections 16, 17, 18, 19, 20, 21 and 22 of UPA Act.
It is submitted on behalf of the petitioner that he has been falsely implicated in this case and though it is alleged that one Country-made Pistol, three cartridges and two Detonators were recovered from the possession of the petitioner but nothing has been stated that as to whether they are in working condition or not. Heard learned A.P.P. also.
Having heard both sides. From perusal of the seizure list
Patna High Court Cr.Misc. No.5168 of 2017 (2) dt.16-02-2017 2/2 itself, it appears that one country-made Pistol, three cartridges and four detonators were recovered from the possession of the petitioner and the petitioner is accused in four other cases. As such, I am not inclined to grant bail to the petitioner at this stage, however, the petitioner may renew his prayer before the court concerned itself after framingof the charges and the learned court below will pass appropriate order on the basis of materials available on the record, without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
