====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. As per prosecution case, allegation against this petitioner is of committing murder of the son of the informant. Learned counsel appearing for the petitioner submits that petitioner is not named in the F.I.R. and has been made accused on the basis of confessional statement of co-accused, namely, Mantu Tiwari. The only material that has come against the petitioner is that as per mobile location, petitioner was on the place of occurrence at the time of offence and there is no other evidence to show that petitioner was involved in the

Patna High Court CR. MISC. No.10903 of 2023(2) dt.15-05-2023 2/2 alleged occurrence. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-1st, Bagaha, West Champaran in connection with Bagaha P. S. Case No. 364 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
