JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-05-2019 This application, for grant of anticipatory bail, arises out of Agamkuan P.S. Case No. 941/18, disclosing offences under Sections 147, 149, 341, 323, 354(a), 385, 504, 506 and 509 of the Indian Penal Code and Section 37 (C) of Bihar Prohibition of Excise Act, 2016.

Allegation as per F.I.R. that petitioners came on the stage in drunken condition and started dancing with the informant, who is orchestra dancer and also used vulgar language.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and except the allegation that the climb on the stage and started dancing, there

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna, in connection with Agamkuan P.S. Case No. 941/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is further subject to the condition that they will cooperate in investigation of the case and will appear as and when required by the police, except on showing genuine reasons.
