JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 15.9.2015 in a case registered for the offences punishable under Sections 341,323,379 and 498A of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner earlier filed Rajnagar P.S. Case No. 22 of 2014 making accusation under sections 364 and 366 IPC against the informant and thereafter as a retaliatory measure the present case

Patna High Court Cr.Misc. No.58209 of 2015 (2) dt.04-01-2016 2/2 has been filed. More over, the investigation has already concluded. Considering the fact that the investigation has already concluded, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur in connection with Lakhnaur P.s. Case No. 28 of 2014.
