JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2020 Petitioner seeks bail in connection with Saraiya P.S. Case No. 534 of 2019, registered for the offences punishable under Sections 363, 366A, 376, 504/34 of the Indian Penal Code and Sections 4/8 of POCSO Act.

Allegation against son of the petitioner is of having sexual intercourse to the minor daughter of the informant and she became pregnant and when they came to make complaint about the same the petitioner and other accused persons abused them and assaulted them.

Submission of learned counsel for the petitioner is that whatever allegation is there that is against son of the petitioner and not against the petitioner and he is in custody since 7.12.2019.

No.8761 of 2020(2) dt.28-02-2020 2/2 In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Muzaffarpur, in connection with Saraiya P.S. Case No. 534 of 2019 on the condition that he has to co-operate in disposal of the trial and has to appear in court as and when required, otherwise his bail bonds shall be cancelled.
