Mr. A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-07-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Murar Police Station Case No. 107 of 2020 registered for the offences punishable under section 307 and other allied sections of the Indian Penal Code.
As per the prosecution case, this petitioner is alleged to have hurled iron rami blow on the head of the informant as a result of which he sustained grevious head injury and fell down. Thereafter all the accused persons assaulted him as a result both hand and leg got fractured. In past also the petitioner assaulted the aunt and his nephew for which Murar Police Station Case No. 22 of 2020 was lodged against them.
Learned counsel for the petitioner submits that the parties are agnate and admittedly there is land dispute between
Patna High Court CR. MISC. No.20363 of 2021(2) dt.13-07-2021 2/2 the parties for which petitioner has also filed a title partition suit against the informant and others. Petitioner is in custody since 21.11.2020. Charge sheet has already been submitted. Learned counsel for the State opposes the prayer for bail and submits that the petitioner is accused in other criminal cases and there is allegation that he assaulted the informant with iron rami on his head and during course of investigation it has come that this petitioner and his family members are trying to usurp the property of informant which informant is willing to give to his three daughters.
In view of the nature and gravity of allegation against the petitioner, his prayer for bail is refused. (Prabhat Kumar Singh, J) Shashi U T
