JUSTICE ARUN KUMAR ORAL ORDER 06-02-2017 Let the defect point out by the office be ignored. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in connection with a case registered under Sections 467, 468, 420, 414, 120(B) of the Indian Penal Code and 66 I.T. Act.

Allegation in brief is that seven stolen mobiles were recovered from the house of the petitioner. It is alleged that those mobiles were stolen one and two cases were lodged relating to the same occurrence.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is employee in Raj Communication and mobiles were with him for repairing purpose and he is in custody in this case since 20.9.2016 and except these two cases, no any

Patna High Court Cr.Misc. No.5394 of 2017 (2) dt.06-02-2017 2/2 criminal case is against him and other two accused Md. Faishal Khan and Md. Reyaz Khan have been granted regular bail by a Co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances, let the petitioner, Md. Saddam Sohel @ Saddam Suhail be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Patna in connection with Pirbahore P.S. Case No.257 of 2016.
