JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under section 498A and other allied sections of the Indian Penal Code and sections 3 & 4 of the Dowry Prohibition Act.
Allegation against this petitioner is of torture and harassment for dowry.
Learned counsel appearing for the petitioner submits that the petitioner is mother-in-law of the victim, whereas her husband has not been made accused in the case. Petitioner is old lady and separate in mess and business. Allegation of torture are general and omnibus in nature against her. Considering the aforesaid facts and circumstances of

No.12145 of 2023(2) dt.16-05-2023 2/2 the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Raxaul Motihari in Trial No. 5091 of 2022/ Complaint Case No. 98 of 2022, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
