The petitioner seeks bail in connection with Durgawati P.S. Case No. 237 of 2021 instituted for the offences under Sections 30(a) and 41(i) of the Bihar Prohibition & Excise Act, 2018.

Learned counsel for the petitioner submits that petitioner is in custody since 29.10.2021, charge sheet has been submitted and is a person of clean antecedent and allegation is of recovery of 1103 liters of liquor from a Pick-up van. Learned counsel for the petitioner submits that petitioner is the Khalasi of the Pick-up Van and as such, he was not knowing what was kept on the van by the owner of the vehicle.

Patna High Court CR. MISC. No.11027 of 2022(2) dt.11-03-2022 2/2 Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 29.10.2021, charge-sheet has been submitted in the case and is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Kaimur at Bhabua in connection with Durgawati P.S. Case No. 237 of 2021.
