The petitioner is languishing in custody since 04.01.2016 in connection with Phulwarisharif P.S. Case No. 667 of 2015 for the offences instituted under Section 392 of the IPC. The prosecution story, in brief, is that the prosecutrix Sujata Kumari on 22.09.2015 was going to take part in monthly meeting to her Department and when she reached near the boundary wall of AIIMS residential colony, a miscreant, came on motorcycle and snatched her golden chain and fled away. It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.01.2016 and the charge sheet has
Patna High Court Cr.Misc. No.6437 of 2017 (3) dt.28-02-2017 2/2 been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He is not named in the FIR. He has not been put on T.I. Parade. There is no recovery of any incriminating article from possession of the petitioner. The name of the petitioner has come on his self confession.
On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.
