Earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 22.08.2016 passed in Cr. Misc. No. 34223 of 2016, giving liberty to the petitioner to renew his prayer for bail, if his trial is not concluded within four months from the date of receipt/ production of a copy of this order. Submission on behalf of the petitioner is that the trial of the petitioner has not been concluded as yet. Taking note of the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that petitioner does not have any criminal antecedent and, moreover, he was driver of the van from which the alleged recovery was

Patna High Court Cr.Misc. No.6178 of 2017 (2) dt.01-03-2017 2/2 made, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Aurangabad ( Bihar) in connection with NTPC Khaira P.S.Case No. 22 of 2016.
