ANJANA MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Complaint Case No. 69/2013 registered for the offence punishable under Section 376 of the Indian Penal Code. Learned counsel for the petitioner submits that there is land dispute between the two families, as a result of which, the present case has been filed with motive of causing social disgrace to the family of the petitioner. It is further submitted that some lands have been sold after partition and now the petitioner is not residing with the family but the family of the complainant is claiming the said land. It is in retaliation to the same that the present
Patna High Court Cr.Misc. No.3966 of 2016 (3) dt.28-04-2016 case has been lodged.
Considering the nature of allegation made and also that the petitioner has no criminal antecedent, let the petitioner above named, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Complaint Case No. 69/2013 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
