2. The petitioner has preferred this application for grant of regular bail in connection with Minapur P.S. Case No. 01 of 2024 dated 01.01.2024 registered for the offences punishable u/ss 272, 273 of the Indian Penal Code and u/ss 30(a) and 37 of the Bihar Prohibition and Excise Act and u/ss 25(1-b)a, 26 of the Arms Act.

3. As per the prosecution case, total 5 litres of illicit country made liquor was recovered from the house of the petitioner. One country made pistol was also recovered from the possession of the petitioner. It is further alleged that the when police apprehended the petitioner who was in drunken condition.

4. Learned counsel for the petitioner has submitted that

No any incriminating article has been recovered from the conscious possession of the petitioner. It is further submitted that the petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 01.01.2024 as stated in para 2 of the supplementary affidavit filed on behalf of the petitioner.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Muzaffarpur in connection with Minapur P.S. Case No. 01 of 2024.

7. The application stands allowed.
