The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 323, 307, 504 and 506 of the Indian Penal Code.
The allegation against the petitioner is of assaulting on the head of Chandrika Yadav by means of tangi, as a result of which, blood was oozing from his head. It is further alleged that then other co-accused persons having lathi in their hands, assaulted the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.12.2016. The charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.6811 of 2017 (2) dt.03-03-2017 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The nature of injury is said to be simple. Hence, no offence under Section 307 of the Indian Penal Code is made out against the petitioner. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Jamui in connection with Sono P.S.
