2. The petitioner has preferred this application for grant of regular bail in connection with Mohania P.S. Case No. 563 of 2024 dated 28.08.2024 registered for the offences punishable under Sections 8(c) and 21(b) of the Narcotic Drugs and Psychotropic Substance Act.

3. As per the prosecution case, total 34.51 gram of smack in 40 packets was recovered from the possession of the co-accused, Saddam Farukhi, who disclosed that he is selling these packets in Rs. 800/- with the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.9445 of 2025(2) dt.15-04-2025 2/3 this case. The name of the petitioner has sprung up in this case in the confessional statement of the co-accused, Saddam Farukhi. No incriminating article has been recovered from the conscious possession of the petitioner. The seized contraband is below the commercial quantity. The petitioner has no concern with the alleged recovery. The petitioner has one criminal antecedent as stated at para 2 of the supplementary affidavit filed on behalf of the petitioner. The petitioner is in custody since 23.12.2024. The co-accused has been granted regular bail by a Co-ordinate Bench of this Court vide order dated 08.01.2025 passed in Cr. Misc. No. 87709 of 2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Kaimur (Bhabhua) in connection with Mohania P.S. Case No. 563 of 2024, with the condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.9445 of 2025(2) dt.15-04-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
