2. The petitioner has preferred this application for grant of regular bail in connection with Amdabad P.S. Case No. 97/2024 dated 28.05.2024 registered for the offence punishable u/s 395 of the Indian Penal Code.

3. As per the prosecution case, six unknown miscreants ridden on two motorcycles are alleged to have intercepted the informant and assaulted him and snatched his bag containing Rs. 50,000/- cash and other belongings and fled away.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

The name of the petitioner has sprung up in the confessional statement of the co-accused, Ijamul Haque. The other co-accused person has already been granted bail by the Co-ordinate Bench vide order dated 24.01.2025 passed in Cr. Misc. No. 74180/2024. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has submitted that the mobile phone which was recovered from the possession of the petitioner belongs to him. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 29.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that one mobile phone was recovered from the possession of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with Amdabad P.S. Case No. 97/2024.
