JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 03-04-2017 Heard learned counsel for the appellants as well as learned Special P.P.

Informant who happens to be a grocery shopkeeper had delayed in serving the appellants on account thereof, he was assaulted. On his hue and cry, his father and wife came who were also assaulted by the appellants along with others with lathi and iron rod. During course thereof, appellant No. 1 Vikash Kumar @ Nanhku tried to outrage modesty of wife of informant. Appellants are in custody since 30.11.2016 having no criminal antecedent. Accordingly, appellants Vikash Kumar @ Nanhku, and Raushan Kumar @ Chhotu each are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand)

Patna High Court CR. APP (SJ) No.341 of 2017 (3) dt.03-04-2017 2/2 with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Amba P.S. Case No. 80 of 2016, after setting aside the order dated 05.01.2017 passed by Special Judge-I, SC/ST, Aurangabad in B.P. No. 1739/16.

Consequent thereupon, appeal is allowed.
