The petitioner, being the husband of the informant, is languishing in custody since 10.10.2018 in a case registered for the offences punishable under Sections 341, 323, 498(A), 504 and 506/34 of the Indian Penal Code.
The prosecution case is that the informant claims to have married with the petitioner on 10.02.2013 in a temple, but since it was a love marriage, torture was inflicted upon the informant by the in-law's family member. It is also alleged that life threat was given to the informant. It is further alleged that the petitioner is having some illicit relationship with some other

It is submitted by learned counsel for the petitioner that petitioner is not in a position to reconcile the issue. It is further submitted that for the purpose of extortion of money from the petitioner, the present case has been lodged against the petitioner. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent. Learned counsel for the informant submits that the informant is still ready to reconcile the matter and restart the conjugal life.
Considering the nature of accusation and investigation already being concluded, coupled with the fact that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-7th, Gaya in connection with Delha P.S.
