JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-09-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 378C /2016, disclosing offences under Sections 341, 323, 406, 420, 469, 468, 471 and 504 of the Indian Penal Code.

Allegation as per complaint petition is that complainant had 7 decimal of ancestral land out of which, the petitioner got executed 3 decimal of land in his favour and in collusion with Karamchari got the mutation of those land done. Submission of learned counsel for the petitioner is that police after investigation has submitted the final form finding the case of civil nature but in spite of that cognizance has been taken against the petitioner.

Patna High Court CR. MISC. No.29644 of 2019(4) dt.27-09-2019 2/2 Heard learned A.P.P. as well as learned counsel for the complainant.

Having heard both sides, considering the facts and circumstances, this application is allowed. Provisional bail earlier granted to the petitioner vide order dated 31.07.2019 is confirmed, subject to the condition that petitioner has to cooperate in disposal of complaint case.
