The petitioner is accused in connection with Parbatta P.S. Case No. 296 of 2014 registered under Sections 419, 420, 468, 471, 147, 149, 353, 332, 337 and 307 of the Indian Penal Code and Section 3/4 of the Prevention of Damage to Public Property Act.
The accusation is that the police, on receiving secret information about doing the brokery, raided the electric shop of Ashok Kumar Sharma and seized different documents as detailed in the F.I.R. At that time, Ashok Kumar Sharma, raised alarm and called his supports then 11 persons including the petitioner reached there and started pelting stone and damaged the police Jeep.

No.6272 of 2017 (2) dt.08-03-2017 Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. along with 10 others, who reached at the alarm of Ashok Kumar Sharma and damaged the police jeep but no specific overt act has been attributed against the petitioner. It is further submitted that petitioner has no criminal antecedent and is in custody since 28.11.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Khgaria, in connection with Parbatta P.S. Case No. 296 of 2014. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
