Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel appearing on behalf of the victim/opposite party no.2, the daughter of the informant.

The petitioner seeks bail in connection with Nanpur P.S. Case No.92 of 2015 registered under Sections 363 and 366(A)/34 of the Indian Penal Code.

The accusation is of kidnapping the victim/opposite party

Patna High Court Cr.Misc. No.3459 of 2017 (3) dt.13-04-2017 2/3 no.2, the minor daughter of the informant, by this petitioner. Learned counsel appearing on behalf of the petitioner submits that while the victim/opposite party no.2, the minor daughter of the informant, who came in touch of the petitioner after the death of the first wife of the petitioner, under pressure gave her statement under Section 164 of the Code of Criminal procedure stating about her kidnapping by this petitioner but, at present, the victim/opposite party no.2, the minor daughter of the informant, is residing with the petitioner after her release on 01.07.2016 by the court of the Sub Divisional Judicial Magistrate, Pupri, Sitamarhi. The petitioner is in custody since 23.06.2016.

Sri Jagdish Prasad, learned counsel appearing on behalf of the victim/opposite party no.2, the daughter of the informant, submits that after her release on 01.07.2016 by the court of the Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, the victim/opposite party no2, the daughter of the informant, is residing with the petitioner as wife.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in
