2. The petitioner has prayed for bail in connection with Biharsharif P.S. Case No.427 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 76, 109(1), 351(2) and 3(5) of B.N.S. and Section 27 of the Arms Act.
3. The case of the prosecution, in short, is that the petitioner along with others arrived at the shop of the informant. It is alleged that one Karu Paswan who was having pistol in both of his hands has threatened her and has made fire in air.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. From perusal of the F.I.R. it is clear that the main thrust of
Patna High Court CR. MISC. No.10412 of 2026(2) dt.20-02-2026 2/2 allegation is against Karu Paswan. There is no allegation of any overt act against the petitioner. Learned counsel for the petitioner has submitted that petitioner is having criminal antecedent of four cases and all the cases are filed by the informant herself. He is languishing in judicial custody since 25.09.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif in connection with Biharsharif P.S. Case No. 427 of 2025.
