Neither petitioner was caught on the spot nor anything was either recovered from his conscious possession or from his house. The name of this petitioner was disclosed by coaccused who were caught on the spot. Petitioner does not have any criminal antecedent and one co-accused, namely, Bijay Kapri, from whose house cartridges had been recovered, has already been granted privilege of bail by a co-ordinate Bench of this court.
