2. The petitioner seeks bail in connection with C.A. Case No. 02 of 2016 registered for the offence under Sections 323, 498(A)/34 of I.P.C. and 3⁄4 of D.P. Act.
3. The petitioner is named in the complaint case and is in custody since 04.09.2024.
4. The allegation against the petitioner is to commit cruelty alongwith other co-accused persons/ family members upon the complainant Indu Devi due to non-fulfillment of demand of dowry as raised for cash of Rs. 25,000/-.
5. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.11165 of 2025(8) dt.04-08-2025 2/3 petitioner submitted that petitioner being husband was earning somewhere outside the village and therefore he was not aware about the cognizance order and as he came to know about the present criminal proceedings, he approached this Court for anticipatory bail in the year 2024 where his anticipatory bail was rejected by one of the learned Coordinate Bench of this Court through Cr. Misc. No. 44787 of 2024 vide order dated 21.08.2024, on ground of delay whereafter petitioner immediately on 04.09.2024 surrendered before the learned court below and since then he is in custody. It is submitted by learned counsel that the allegation as raised through complaint petition appears not specific against this petitioner and moreover wife of the petitioner and in-laws unfortunately died in a road accident in the year 2022. It is submitted that even complaint petition suggest general and omnibus allegation qua demand of dowry against petitioner.
6. Learned APP duly assisted by Mr. Binod Kr. Singh, learned counsel appearing for the informant while opposing the prayer of bail could not dispute the aforesaid

In view of aforesaid factual submission and by taking note of fact that with aforesaid allegation petitioner remains in custody since 04.09.2024, accordingly petitioner above named, is directed to be released on bail in connection with C.A. Case No. 02 of 2016 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Patna City, Patna /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
