The petitioner seeks bail in a case under Section 302 and other sections of the Indian Penal Code.

The prayer of the petitioner for bail was earlier rejected twice by this court. On 03.03.2015 the prayer of petitioner for bail was rejected with a direction to the trial court to conclude the trial within nine months and if the trial is not concluded within nine months the petitioner may renew his prayer for bail. It is submitted that even after lapse of one year, the trial has not yet been concluded but it appears from the report of Superintendent of Police, Katihar that the witnesses are being examined and trial is its fag end.

Considering the nature of allegation made against the

Patna High Court Cr.Misc. No.605 of 2016 (5) dt.18-05-2016 2/2 petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

The learned trial court is directed to conclude the trial within four months from the date of receipt of this order and if the witnesses are not turning up for their examination, the learned trial court shall report the matter to this court forthwith. (Prabhat Kumar Jha, J) BKS/- U T
