JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 10-05-2017 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 399, 402, 212 of the Indian Penal Code and 25(1-b)a, 26(ii), 35 of Arms Act.
On receiving secret information that some miscreants have gathered for committing heinous crime, the police reached at Chandi More, Harnaut and started checking. At that time one Bolero and one motor cycle were coming in suspicious condition and on seeing the police party the drivers of the vehicles tried to flee away but on chase eight persons including the petitioner were apprehended. The petitioner was found in possession of two sets of mobile. The other persons were found in possession of country
Patna High Court Cr.Misc. No.20070 of 2017 (2) dt.10-05-2017 2/2 made pistol and live cartridges.
Submission is that the petitioner has no criminal antecedent. He was found in possession of only two sets of mobile. The petitioner is in jail custody since 01.01.2017. Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda in connection with Harnaut P.S.Case No. 337 of 2016.
