JUSTICE ASHUTOSH KUMAR ORAL ORDER 13 03-04-2018 The petitioner has challenged the order dated 02.07.2012 passed by the learned Sub-Divisional Judicial Magistrate, Chapra in connection with Complaint Case No. 670 of 2012 whereby cognizance has been taken against the petitioner under Section 498(A) of the Indian Penal Code and Section 3 of the Dowry Prohibition Act.

Though the petitioner has raised some points with respect to facts of the case but the records reveal that the matter was sent to the Mediation Centre of Patna High Court on the submission of the learned counsel for the petitioner that there is a possibility of settlement and that the petitioner

Patna High Court Cr.Misc. No.15579 of 2014 (13) dt.03-04-2018 2/2 is exploring such possibility. The records further reveal that no decision at the Mediation Centre could be taken because the petitioner never appeared before the Mediation Centre. In that view of the matter, there is no reason for keeping this petition pending.

It further appears that the case before the Court below has been stayed by the order of this Court. The stay stands vacated.

The petition is dismissed.
