JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, the name of petitioner surfaced in this case. It is pointed out on behalf of the petitioner that after investigation, police submitted final form finding no evidence but subsequently, again the matter was reopened and on the basis of confessional statement of co-accused, petitioner has been dragged in this case and he is in jail custody since 12.09.2015 but the investigating officer did not take pain to arrange T.I.Parade. It is further stated that petitioner was arrested in Dawath P.S.Case No. 122 of 2014 and after that he was remanded in some cases, in which petitioner had not been named in the first information report

Patna High Court Cr.Misc. No.1413 of 2016 (2) dt.14-01-2016 2/2 as accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Mohania P.S.Case No. 196 of 2013.
