The petitioner, who is in custody, seeks bail in connection with Patory (Mohanpur O.P) P.S.Case No. 94 of 2016 registered under Sections 302 and 201/34 of the Indian penal Code.

Allegation in brief is that informant's sister was married with the petitioner 12 years back and it is alleged that due to non-fulfillment of demand of dowry, she was killed. Submission is that the police has concluded the investigation and found the case only against under Section 306 of the Indian Penal Code and submitted the chargesheet and the petitioner's wife committed suicide as there was some quarrel on the fateful day and there are three children out of their marriage

Patna High Court Cr.Misc. No.5383 of 2017 (3) dt.08-03-2017 2/2 and this petitioner has been in custody since 03.09.2016. Having considered the aforesaid facts and circumstances, the petitioner, namely, Vishwanath Rai, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Samastipur in connection with S.T. No. 716 of 2016 in Patory (Mohanpur O.P) P.S. Case No. 94 of 2016. (Arun Kumar, J) Sujit/- U
