The petitioner is accused in connection with Bangaon P.S. Case No. 101 of 2016, registered under Sections 147, 148, 149, 341, 379, 380, 427, 504 and 506 of the Indian Penal Code and Section 25(1-b)a, 26, 27 and 35 of the Arms Act. The accusation is that 09 persons named in the F.I.R., including the petitioner, came at the land of the informant, where informant was constructing house, and started to abuse him saying that why ransom has not been paid to them. At that time, Chandeshwari Poddar opened firing at the brother of the informant, but the same did not hit his brother. At that time, this petitioner pointed pistol at Umesh, uncle of the

Patna High Court Cr.Misc. No.3914 of 2017 (2) dt.23-02-2017 2/2 informant, who was sitting in the shop and Anil Kumar, son-inlaw of Chandeshwari Poddar took Rs. 50,000/- from the cash box.

Learned counsel for the petitioner submits that petitioner and informant are lived in the same market and due to land dispute the petitioner has been implicated in this case. The petitioner is in custody since 05.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-1st, Saharsa in connection with Bangaon P.S. Case No.101 of 2016. (Rajendra Kumar Mishra, J) manish/- U T
