The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/498A/34 and other ancillary sections of the Indian Penal Code. Learned counsel for the petitioner denies the allegation of torture and assault and submits that the petitioner is ready to keep his wife with dignity. petitioner has also filed Matrimonial case no. 130 of 2018 for restoration of conjugal rights.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Madhubani in Khajauli Police Station Case No. 79 of 20-18/CRI No.1029 of 2018 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
