The petitioner is accused in connection with Aadapur P.S. Case No. 135 of 2016, registered under Sections 272, 273 of the Indian Penal Code and Section 47(a), 53(b) of the Bihar Excise Amendment Act, 2016.

The accusation is of recovery of 9 bottles, each containing 180 ML Nepali liquor from the possession of the petitioner and also 52 bottles, each containing 300 ML kept in two cartons recovered from the Tanga, who which the petitioner was found sitting.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent is in custody since

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Raxaul at Motihari in connection with Aadapur P.S. Case No. 135 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
