Petitioner, namely, Chandan Kumar @ Chandan Singh is in custody since 26.06.2015 in Alipur P.S. Case No.23 of 2015 under Sections 341, 323, 324, 307, 380, 457 and 504/34 I.P.C. According to the prosecution case, the petitioner entered the house of the informant to commit theft and when the informant awoke, the accused started to flee away after committing theft. On the informant's hulla, with intention to kill the informant, the petitioner assaulted on her head repeatedly with iron rod. Subsequently she found that her golden chain and ear ring were missing.

The learned counsel for the petitioner submitted that the petitioner is next door neighbour of the informant and there is

Patna High Court Cr.Misc. No.55564 of 2015 (2) dt.14-12-2015 land dispute between the parties. It is further submitted that the petitioner is gotia of the informant and because of the strained relationship the false case has been filed.

In view of the above facts and circumstances of the case I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Alipur P.S. Case No.23 of 2015.
