The Petitioner seeks bail in Ishipur (Barahat) P.S. Case No.77 of 2016 instituted for the offence under Section(s) 354-B, 376, 511 Indian Penal Code.
It has been submitted that the petitioner is the own uncle of the victim and has been falsely implicated because of land dispute.
From the written report, it appears that there is general allegation that the petitioner caught hold the victim when she went in the maize field and started indecent behaviour with her. When she wanted to run away, he attempted to commit rape with her. She raised alarm then her mother and Fuaa arrived and
Patna High Court Cr.Misc. No.2215 of 2017 (2) dt.02-02-2017 2/2 the petitioner fled away.
In this manner, there is only allegation that he attempted to commit rape. The petitioner is in custody since 24.08.2016.
Considering the aforesaid, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VIII, Bhagalpur, in connection with Ishipur (Barahat) P.S. Case No.77 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
