This application, for grant of anticipatory bail, arises out of Durandha Police Station Case No. 256 of 2019, disclosing offences under Sections 30(a), 38 of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioner is that the total quantity of 10 litres of illicit mahua liquor has been recovered from the room of the petitioner made of corrugated sheets. Learned counsel for the petitioner submits that similarly situated accused person has been granted bail by this Court inasmuch as the police has recovered a total quantity of 30 litres of illicit mahua liquor from the co-accused Sunil Chaudhary. Learned counsel placed the order dated 13.02.2020

Patna High Court CR. MISC. No.9475 of 2020(2) dt.03-03-2020 2/2 passed in Cr. Misc. No. 83404 of 2019 in support of his submission. Similarly situated accused person has been granted bail by this Court accordingly I am inclined to grant anticipatory bail to the petitioner on the same term as was imposed by the Co-ordinate Bench in granting bail in Cr. Misc. No. 83404 of 2019 vide order dated 13.02.2020.

Let the petitioner deposit a sum of Rs. 1000/- in the Juvenile Justice Fund of the State Social Department and on the deposit of the aforesaid amount, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Siwan in connection with Durandha Police Station Case No.256 of 2019, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
