JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 467, 468, 471, 401, 413, 414 and 34 of the Indian Penal Code.

It has been submitted that the petitioner is not named in the First Information Report. His name has been disclosed in the confessional statement of co-accused Md. Rahil. From the written report itself, it appears that one Md. Kalim was apprehended on the spot and he disclosed the name of another person who managed to run away, was Md. Rahil, who is his son. The police recovered motorcycles from the house of Md. Rahil as mentioned in the written report. The name of the petitioner has been disclosed by co-accused Md. Rahil. There is

Patna High Court Cr.Misc. No.2283 of 2017 (2) dt.04-02-2017 2/2 no recovery of any incriminating article from the possession of the petitioner. The petitioner is said to be in custody since 16.9.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K.
