JUSTICE SANDEEP KUMAR ORAL ORDER 10-01-2022 Heard the learned counsel for the petitioners and learned Additional Public Prosecutor for the State. At the very outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail against petitioner No.3, as such, the anticipatory bail application as against petitioner No.3 is hereby rejected.

So far as petitioner No.1 and 2 are concerned, this application, for grant of anticipatory bail, arises out of Kateya Police Station Case No. 376 of 2020, disclosing offences under Sections 341, 323, 325, 307/34 of the Indian Penal Code. Petitioner No.1 and 2 are the agnates. There is case

Patna High Court CR. MISC. No.20684 of 2021(4) dt.10-01-2022 2/2 and counter case.

Considering that nature of the case as well as nature of allegation, this application for anticipatory bail is allowed.

Let the petitioner No.1 and 2, named above, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Kateya Police Station Case No. 376 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
